If someone wrecks, totals, your car, civil court will award you the "Blue Book" value of the car. However, the value awarded is not what it would cost you to replace the car - the dealer value - which in the book includes the "costs of business". You get the private party sale value, which is significantly less.

So, if the guy wrecks your car, he has to give you $13,000, and then you have to go shopping, dealing, and pay a used car dealer $18,000 for the exact same car.

That doesn't seem fair.

I think the bad guy should be required to do the shopping, the dealing, and present you with a paid-for replacement car, which meets your mechanic's approval.

I admire you your ability to be indignant. Maybe you haven't lived in Jersey long enough. You are going to get screwed, screwed, screwed and you will not enjoy it.

I have accepted it. Actually, I don't care about much of anything anymore and I figure that if something happens, I'm going to be screwed and I will not like it.

But that's just me.

Actually, it applies to not just NJ, it's all states. AND also what your auto insurance would pay. They all use the private Blue Book number, not replacement cost.

Oddly enough, I was able to get actual replacement value for my home insurance and furnishings. But not auto insurance.
